Terms of service and Liability Waiver

ALPHA SUPERIOR MADRID TERMS OF SERVICE AND LIABILITY WAIVER

In consideration of being allowed to participate in the event or activity referenced above, I acknowledge, appreciate, and agree that:

  1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death. While particular rules, equipment, and personal discipline may reduce this risk, I understand that the risk of serious injury does exist.

  2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation.

  3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

  4. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless the Releasees, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event ("Releasees"), with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of Spain. Any disputes arising out of or in connection with this agreement shall be settled under the exclusive jurisdiction of the courts of Madrid, Spain.

Severability: If any provision of this agreement is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

2024-2025 ALPHA SUPERIOR MADRID Financial Agreement

BACKGROUND:

I would like my child/ren to be enrolled to attend Alpha Superior Madrid (ASM). In order to attend ASM and remain registered, ASM requires that I pay in full the total of any fees, tuition, and other miscellaneous charges incurred in connection with my child's enrollment at ASM, on the dates indicated by ASM for the Tuition Due Date, and until all debts to ASM are paid, whichever is the latter event. ASM will provide me with access to an online account with LeagueApps, Stripe, or other invoicing services by which to pay. Through my LeagueApps account or other payment services, among other things, I will be able to access billing information. The consequences of failure to pay amounts owed by the relevant Tuition Due Dates are outlined in the provisions below.

TERMS OF AGREEMENT:

In consideration of the extension of credit to me, I hereby acknowledge and agree as follows:

FINANCE CHARGES AND AMOUNTS OWED

I agree to pay the full amount of all tuition, fees, and other charges related to my account and assessed by ASM, and any other late charges and collection costs that may become due as provided in this agreement. I understand that my failure to pay any amounts assessed by ASM, when due, may result in the cancellation of enrollment without further advance notice and that enrollment for future years will not be permitted unless my account balance is current. Withdrawing from ASM does not eliminate my legal financial obligation to any remaining installments or balances.

DEFAULT

If I fail to make any payment when due, ASM may declare the entire balance of any amounts owed (including principal, interest, late charges and collection costs) to be due and payable within 15 days after giving me written notice of such default if I fail to make the payment that is due, within the same 15-day period. Late charges and interest are assessed at 12% annually. I hereby authorize the ASM Business Office to restrict the use of my records to prevent my enrollment and to withhold my transcripts in the event that I fail to comply with the payment obligations of this Agreement. Written notice will be delivered via email or certified mail.

PAYMENTY METHODS

Payments may be made on LeagueApps utilizing a credit card, Stripe, or other invoicing services, checking or savings account, and is the preferred payment method at ASM. In addition to LeagueApps and Stripe, ASM accepts payments via cash or wire transfer. Credit card payments must be made via LeagueApps, Stripe, or other invoicing services via invoice. In accordance with new security measures, no payment of any kind should be given to any unauthorized person or staff member. All cash or wire transfer payments must be verified with the ASM Business Office.

CHANGES OF TERMS

ASM has the right to unilaterally make changes affecting the future terms of my account, including finance charges to be imposed. ASM will notify me of any such changes 30 days prior to the effective date by mailing such notice to my last known address or email.

CHANGES AND RELEASE OF INFORMATION

I agree to inform the school (Business Office) of any change in my name, address or telephone number, in a timely manner. I hereby give notice and full consent to allow ASM, at its option, to report favorable and unfavorable credit information pertaining to myself to recognized credit bureaus and other non-campus third parties.

COLLECTION COSTS AND LATE FEES

In the event that I fail to comply, in a timely manner, with the payment obligations detailed in this Agreement, I further agree to pay all costs of collection incurred by ASM including, but not limited to, collection agency fees, credit bureau fees, legal filing fees, service of process fees, publication fees, witness fees, reasonable attorney fees, and recording fees. I also agree to pay any late fees that may apply. Late fees will be calculated as follows: 2% of the outstanding balance for each month the balance remains unpaid.

GOVERNING LAW AND JURISDICTION

This agreement shall be governed by and construed in accordance with the laws of Spain. Any disputes arising out of or related to this agreement will be settled under the jurisdiction of the courts of Madrid, Spain. However, in the case of disputes involving U.S. residents, the parties may agree to submit to binding arbitration in a mutually agreed-upon location, under international arbitration rules, to resolve any conflict in a more neutral setting.

FORCE MAJEURE

ASM shall not be liable for any failure to perform its obligations under this agreement if such failure is caused by circumstances beyond its reasonable control, including but not limited to, acts of God, government restrictions, natural disasters, or pandemics.

DATA PROTECTION

ASM will ensure that any personal information collected under this agreement will be processed in accordance with applicable data protection laws, including GDPR, if applicable. By signing below, I agree that ASM may collect, use, and store my data as necessary for the execution of this agreement and for any legal or regulatory obligations.
